"The administration is keen on the Senate voting on the S3709 (United States India Peaceful Atomic Energy Cooperation Act) as it stands today. The administration is quite aware of India's apprehensions, concerns and objections in the Senate Bill especially as it pertains to Sections 106 (Prohibition on certain exports and re-exports) and 107 (End Use Monitoring programme)," sources told PTI.
They said the thinking was not to start an argument with the Senators when the Senate gets into session after its summer break, but use the Conference stage to apply pressure to drop the provisions.
Indications are that the Bill will come up in the full Senate sometime around the third week of September. But no one has a firm timeline on when it will happen.
It has been pointed out that the White House and the administration are keen to have the Senate pass the measure. Before the Senate went to summer recess last month the administration was said to have leaned on Senate Majority Leader Senator Bill Frist to schedule the vote. That could not be done for time constraints as there were other pressing issues and votes.
The administration is aware of its urgency given that the Senate has just about a month left before it adjourns. The order of business on the nuclear deal is such that the Senate has not only to pass it, but have the versions reconciled so that the Senate and the US House of Representatives can pass the final versions before adjournment of the second session of the 109th Congress on October 6.
All unfinished legislative business will have to be re-introduced in the new 110th Congress when it reconvenes in January 2007. If the character of the US Congress changes in the November 7 election, it would be a totally different ball game, sources said.
The substantive part of the Bill and the expected objections from the Senators aside, there is a larger procedural impediment that is yet to be sorted out -- taking out the Title Two of S3709 that has no relevance to India but a Protocol having to do with the US and the International Atomic Energy Agency.
Several conservative Republicans are reportedly against the Additional Protocol and want it to be debated and voted upon separately.
Law makers like Senators Jon Kyl of Arizona and John Ensign of Nevada are not quite satisfied with the kind of obligations Washington is signing on to by way of an Additional Protocol with the IAEA, especially as it pertains to inspections and payments and even perhaps a perceived interference in the fashion Americans would want to run their programmes.
'Tags' are a routine part of the American legislative process but in the present instance Title 2 of S3709 is more than just a 'political nuisance' as it runs the risk of jeopardising the major and substantive part of the legislation dealing with the India-US nuclear deal.
Diplomatic sources point out that the Additional Protocol will have to be 'de-tagged' from S3709 for the simple reason that the Bill in its original form will have difficulty in rounding up Republican support. The apprehension being that those conservatives law makers inclined to support the nuclear deal will vote against the Senate Bill if the Additional Protocol remains a part of the measure.
But there is confidence that the administration and its allies in the Senate will bring sufficient pressure to 'de-tag' the US-IAEA Additional Protocol from the Bill and efforts to this end will be one of the major behind-the-scene developments taking place over the next several days.
