Mohammed Afzal, sentenced to death in the 2001 Parliament attack case, has moved the Supreme Court seeking review of the judgment saying that he did not a get fair trial.
In his curative petition, Afzal contended that Article 21 (Right to Life) of the Constitution is inviolable. The petition was filed through senior lawyer Kamini Jaiswal.
The curative petition is the last option available in the court.
Earlier, the court had dismissed his review petition against the judgment of August 4, 2005, confirming the death sentence awarded to him by the trial court and the Delhi high court.
Besides Afzal, another person called Shaukat Hussain Guru was sentenced to 10 years imprisonment for not disclosing before the police about the conspiracy to attack Parliament.
The apex court had acquitted S A R Gilani, the Delhi University lecturer in this case.
The court had upheld the acquittal of lone woman accused Navjot Sandhu alias Afsan Guru, wife of Shaukat for her involvement in the case.
Shaukat has also filed a curative petition.
