3-month time for probe insufficient: Shah Commission

The one-man K G Shah Commission appointed by the Gujarat government early in March to inquire into the Godhra train carnage and the subsequent communal violence has indicated that the three-month time given to complete the probe was not sufficient.

The commission began functioning in Ahmedabad on March seven, one day after it was set up by the state government.

Justice Shah, a former Mumbai high court judge, said it was 'impossible' to complete the probe in three months and make the report public.

He said that the exact time needed for the probe would depend on how many people came forward to file affidavits before the commission.

Shah recalled that thousands of affidavits were filed before the commission that probed the Gujarat riots in 1969.

Meanwhile, the Supreme Court on Wednesday directed Dr Mallika Sarabhai, who is seeking a special investigation into the communal riots in Gujarat and a stay on the notification appointing the one-man inquiry commission headed by Justice K G Shah, to withdraw all allegations of bias against the judge.

In her petition, Dr Sarabhai has accused Justice Shah of bias against the minority community.

A three-judge bench headed by Chief Justice S P Bharucha told her counsel E C Agrawala that the charges levelled against Justice Shah were baseless.
