TN will challenge transfer of Jaya's cases in SC

The Tamil Nadu government today informed the Supreme Court that it would challenge within a week the notification issued by the Centre on February 5 transferring 46 corruption cases against former chief minister Jayalalitha, some of her erstwhile cabinet colleagues and bureaucrats from three special courts to sessions court.

In view of this information, a division bench comprising Justices G T Nanavati and S P Kurdukar adjourned hearing of a group of special leave petitions challenging a Madras high court judgement upholding the validity of the notification issued by the state government on April 30, 1997, transferring the corruption cases to special courts.

The SLPs were filed by Jayalalitha and other affected parties.

Earlier, the court enquired whether the notification issued by the Centre was being challenged by anyone, otherwise all pending matters might become infructuous.

Senior counsel F S Nariman, appearing for the Tamil Nadu government, then informed the court that the state would challenge the Centre's notification within a week.

The court then adjourned the hearing observing that the pending SLPs and the writ petition to be filed by the state government would come up for hearing on February 22 for making appropriate order on the writ petition.
