Fardeen gets his car back
A special court directed the Narcotics Control Bureau (NCB) to return the car belonging to film actor Fardeen Khan, facing charge of possessing cocaine, on August 30. The order was delivered by special judge M S Keny, who asked Fardeen to execute a bond of Rs 700,000 for seeking the car from NCB's possession. The court, however, restrained Fardeen from changing the colour of the car or making any alterations. The actor has also been restrained from disposing of the car, which was seized by NCB at the time of his arrest on May 6. The actor's lawyer Ayaz Khan had moved an application seeking return of the Opel Astra car which was seized three months ago. In a related development, Naseer Abdul Karim Shaikh and Tony Gomes, charged with possessing and selling cocaine, were further remanded to judicial custody till September 13. Public Prosecutor Usha Sisodia opposed Fardeen's plea for return of the car. She argued the car was used in the crime and, therefore, should not be returned until the trial was over. Fardeen's lawyer argued that the car was not used in the crime because nine grams of cocaine was recovered from co-accused Naseer Abdul Karim Shaikh who was with the actor when NCB sleuths swooped on them on May 6. He argued that investigations were over and chargesheet had been filed against Fardeen and two others in this case. Hence, there was no need for NCB to retain the car, defense counsel Ayaz Khan submitted. PTI
