NHRC to recommend CBI probe over Tehelka sting

In a setback to the Narendra Modi-led government in poll-bound Gujarat, the National Human Rights Commission on Monday decided to recommend a Central Bureau of Investigation probe into accusations made in the Tehelka sting operation on post-Godhra riots.

"The Commission has decided to direct an inquiry by the CBI into the episode in the light of accusations made in the 'Operation Kalank' on communal violence in Gujarat," a statement from the NHRC stated.

The Commission's observations come after it viewed the tapes of the programme aired by Aaj Tak and found the contents a fit case for probe by an independent agency. 

"The allegations had far-reaching implications and raised vital constitutional issues which need to be promptly addressed in the interest of all," it said.

The rights panel has also directed the state government to communicate its consent for the CBI probe to it and the Centre within two weeks.

"The authenticity of the tapes must be examined and the allegations must be investigated. The investigation must be effective and independent," the Commission said adding that "If the investigation does not substantiate the allegations, it will help clear the air."

If, however, the allegations are found true after-investigation, appropriate corrective action will have to be taken, it said.

The NHRC in 2003 had filed a petition in the Supreme Court seeking transfer of nine cases outside the state and transfer of the investigation into the post-Godhra riots to an independent agency.

The cases arise out of five major incidents of riots in Godhra, Naroda Patia, Gulbarga Society, Sadarpura and Ode in 2002.

The Gujarat government has opposed the plea for shifting the cases outside the state.
