Ahead of the Central Bureau of Investigation's move, Bihar's National Democratic Alliance government on Monday moved the Patna High Court challenging the acquittal of Rashtriya Janata Dal supremo and Railway Minister Lalu Prasad and his wife Rabri Devi in a disproportionate assets case.
Special Public Prosecutor Akhileshwar Prasad Singh, who was recently appointed by Nitish Kumar government to handle the case, filed the petition in the high court challenging the December 18 order of Special CBI judge Munilal Paswan acquitting them of all charges.
Advocate General P K Sahi told PTI that based on the reports submitted by the public prosecutor in the subordinate court, he had recommended to the state government that there were sufficient legal remedies to challenge the order of the designated CBI judge.
Chief Minister Nitish Kumar later gave his nod to the recommendation, Sahi said.
The case was registered by CBI seven years ago. The disproportionate assets case in which Lalu was accused of amassing Rs 46 lakh in property above his known sources of income between 1990 and 1997 as Bihar chief minister was an offshoot of the infamous fodder scam.
Rabri Devi, a former chief minister was accused of abetting her husband. The CBI approached the Union law ministry last week seeking sanction for challenging the acquittal of the Lalu and Rabri.
