The family of Professor H S Sabharwal, who died after being assaulted by some students union leaders in Ujjain, Tuesday moved the Supreme Court seeking a Central Bureau of Investigation probe into the incident alleging that Madhya Pradesh government was not holding an impartial probe.

The petition filed by professor Sabharwal's son, Himanshu was mentioned before a Bench comprising Justice B N Agrawal, Justice P P Naolekar and Justice L S Panta, which fixed Septemeber 25 for its hearing.

Senior advocate Rajiv Tanka sought early hearing on the issue submitting that Sabharwal family was compelled to approach the apex court for handing over the investigation to the CBI as the state police was trying to shield some accused.

The petition said that the state government was no ready to accept that the victim died as a result of the assault by the union leaders.

Instead, leader of the ruling party in the state had been reportedly making statements in favour of the accused.

Police had not registered the case of murder against the accused after Professor Sabharwal died on August 26. The charge was included only after the case was transferred to the CID.

Till now, two persons – Akhil Bharatiya Vidayarthi Parishad leaders Shashi Ranjan Singh 'Akela' and Vimal Tomar -- have been arrested in connection with the case.
