The Bombay High Court, on Wednesday, will hear an appeal filed by Maharashtra government against a lower court order granting bail to one of the two accused of raping a South African model and upcoming actress on the new year eve.
The state contended that the lower court judge had erred in granting bail to Suresh Krishnani.
The appeal filed on Monday argued that there was prima facie evidence against Krishnani and Sunil Morpani, who are charged with picking up the model from a bar in suburban Bandra and taking her in a car to a hotel in nearby Ulhasnagar town before raping her.
The appeal submitted that the victim had suffered injuries on her person, which indicated that she was raped. It also contended that Krishnani came from a wealthy and influential family and would tamper with evidence if released on bail.
The appeal would be heard by Justice V M Kanade. Police had, last week, filed a chargesheet against the duo in the trial court which released Krishnani on bail on the ground that investigations were over.
Meanwhile, the victim has sent an SMS message to her lawyer Falguni Brahmabhatt, saying she would come to India to appear in the trial to ensure that the culprits were punished.
