HC rejects Gawli's petition against lie detection tests

Sighting the court order in Telgi case allowing brain mapping and lie detector test on the accused, the Bombay high court on Wednesday dismissed a petition filed by gangster-turned-politician Arun Gawli seeking direction to restrain Mumbai police from subjecting him to both the tests in Priety Jain conspiracy case.

Hearing Gawli's plea, bench of Justice R M S Khandeparkar and Justice R S Mohite also refused to grant a stay on their order.

The court observed that Gawli's contention that the brain mapping and polygraph test invades the body was wrong while the narco-analysis test was debatable and the matter is pending with the Supreme Court.

It also sighted the court's previous order allowing the brain mapping and lie detector test for the accused in Telgi scam.

According to police, Priety Jain had allegedly hatched a conspiracy to murder film maker Madhur Bhandarkar and given contract money to Gawli's men for this purpose.

Priety and Gawli's man, Naresh Pardesi, were earlier arrested and subjected to scientific tests. Later, three more persons were arrested and a country-made revolver was seized from them.

Police suspect that Gawli was aware of the transaction between his close aide Pardesi and Preity, and may have tacitly supported the murder plan.
