Bharat Shah challenges MCOCA in high court

Film financier Bharat Shah, who is facing trial in a special court for his alleged links with the underworld, has filed a petition before the Bombay hight court questioning the Constitutional validity of the Maharashtra Control of Organised Crime Act (MCOCA).

Shah has prayed that the state legislature had no powers to enact MCOCA as it was ultra vires the Constitution.

He has urged the court to strike down the Act or stay the trial against him.

The petition, which was heard by Justice S S Parkar and Justice Vijaya Tahilramani on Wednesday, has been referred to Chief Justice C K Thakker.
