Encounter specialist Daya Nayak transferred

Mumbai Police inspector Daya Nayak on Friday was transferred from Crime Branch to Charkop police station in suburban Kandivili with immediate effect.

Police Commissioner P S Pasricha gave orders for the transfer of the encounter specialist following the rejection of his petition by the Bombay high court challenging a special court's order, which directed the police to probe his alleged nexus with the underworld on the basis of a complaint lodged by a scribe.

Nayak, who has shot dead 70 gangsters in encounters, was asked by the high court on December 17 to deposit his passport forthwith with the police commissioner.

Based on a complaint filed by a journalist Ketan Tirodkar about Nayak's alleged nexus with Pakistan-based gangster Chhota Shakeel the special court had ordered Assistant Commissioner of Police Shankar Kamble to conduct a probe and carry out searches on his premises.

Accordingly, Kamble probed the matter and filed a report.

Being aggrieved, Nayak had filed a petition in high court, which rejected his contention that the special court cannot entertain a private complaint under MCOCA.

Tirodkar had alleged that he and Nayak had accepted Rs 5 crore from Shakeel to transfer cops. The scribe said he too had committed offence under MCOCA but sought pardon under this stringent law.

Tirodkar, however, was not happy with the action of the Mumbai police. He told rediff.com: "This is a very late reaction from the police department against Daya Nayak. Transferring him to Kandivilli is convienient for Nayak. This is a mild action against him. I had expected Nayak to transferred out of Mumbai."
