Three Hinduja brothers, facing trial in the Rs 640 million Bofors payoff deal case, on Friday moved an application before a special court in Delhi seeking quashing of the charges against them.
The application was moved by Hinduja's counsel, senior advocate Ram Jethmalani before special judge Prem Kumar, who was to commence hearing on the arguments of charges from Friday on day-to-day basis.
Moving the application, Jethmalani sought quashing of the Central Bureau of Investigation charge sheet against Europe-based Hinduja brothers -- Gopichand, Srichand and Prakahchand -- on grounds of delayed trial.
The court directed the CBI to file reply by July 24 and fixed arguments on Hinduja's application on the following day.
Jethmalani said the CBI was responsible for the delay of over 12 years in the probe of the case and filing the charge sheet.
This was contrary to the provisions of Article 21 of the Constitution, which guarantees speedy trial in criminal cases.
The special judge on July 17 had fixed arguments on charges in the case after the Supreme Court had stayed the Delhi high court order quashing the charge sheet against the Hinduja brothers in the case.
