Hinduja brothers get conditional bail

Onkar Singh in New Delhi

Within minutes of being granted conditional bail, the Hinduja brothers moved an application before the Central Bureau of Investigation court asking for permission to leave the country and visit the United States on Friday night.

Judge Ajit Bharihoke, however, rejected the application and asked them to move a proper application later, giving detailed reasons why they should be allowed to go abroad.

The judge directed the CBI counsel N Natarajan to give the chargesheet and other documents to the Hindujas' lawyer.

The brothers -- S P, G P and P P Hinduja -- had been granted conditional bail in the Bofors case, and they have been directed not to leave the country without prior permission of the trial court.

The brothers have been accused of receiving kickbacks from Bofors.

Natarajan contested the plea of the defence counsel that his clients be allowed to leave the country.

The Hindujas have been granted conditional bail on a personal bond of Rs 200,000 each and a surety of a like amount in each case.

When Natarajan said that they required the three for interrogation, the judge told him to sort out the matter with the defence counsel and fix dates for interrogation.

The conditional bond will mean that they have to deposit their passports, should the CBI require them. However, the CBI has not yet done that.

Within an hour of their first application being rejected, the three Hinduja brothers moved a detail application giving reasons for going abroad.

Since, the CBI counsel was not present, the judge gave the CBI time till Saturday to oppose the application.

Their application for permission to go abroad would come up for hearing on Saturday, at 1000 hours (IST) in the court of Additional District and Sessions Judge Ajit Bharihoke.
