Verdict on Nadeem's appeal
before Christmas: PTI

The London high court will deliver its judgement before Christmas on an appeal filed by Bollywood music director Nadeem Akhtar Saifi against his extradition to India to stand trial in the Gulshan Kumar murder case.

The high court announced its decision at the end of a four-day hearing that concluded on Thursday.

During the hearing in the case, counsel for the Indian government and Nadeem's counsel based their arguments on the evidence provided by Mohammed Ali Shaikh, who confessed to the murder conspiracy and named Nadeem as co-conspirator.

Forty-six-year-old Nadeem is charged with murdering and conspiring to murder music producer Gulshan Kumar in August 1997.

After a hearing that extended over two years, he was committed for extradition by a London magistrate in October 1999.

Nadeem, on bail on sureties amounting to 200,000 pounds, brought a habeas corpus appeal seeking a high court ruling overturning the magistrate's decision.

In his final submissions, Nadeem's counsel Clive Nicholls qc told Lord Justice Rose and Justice Newman that the Indian government, when pursuing the extradition request, had failed to disclose that Ali Shaikh had retracted his confession until the defence found out about it.

He said it was indicative of a lack of "good faith in the interest of justice."
